Agreeing to these terms
These terms apply to paymenthelp.com and everything on it, including our forms and tools. By using the site you agree to them. If you don’t agree, please don’t use the site. These terms are between you and PaymentHelp.
What PaymentHelp does
PaymentHelp is an independent sales organization (ISO) and payments consultancy. We help businesses find a merchant account with one of our processing partners, and we consult on accounts after approval. We are not a bank or a payment processor. Merchant accounts and payment processing are provided by our processing partners and their sponsor banks.
Quotes and approval
- A quote, estimate or comparison from us is not an offer of credit or of a merchant account, and not a promise of approval.
- Every account is subject to the processor’s and sponsor bank’s underwriting and approval, which we don’t control.
- Your pricing, limits, funding schedule and other terms are set only by the agreement you sign with the processor. If anything we said differs from that agreement, the agreement controls.
Tools and information
Our pages, guides and tools, including the chargeback ratio calculator, give general information. They are not legal, tax, accounting or financial advice, and they may not reflect the latest card-brand or legal changes. Card-brand thresholds and rules change; your acquirer’s figures are the ones that apply to your account. Please don’t rely on the site alone for decisions that matter to your business. Talk to us, and to your own advisers.
What you send us
- Information you give us must be accurate, and you must be authorized to give it for the business you represent.
- Only upload documents you have the right to share.
- Please don’t send card numbers, bank account numbers or Social Security numbers through our forms or by email.
- How we handle what you send is described in our Privacy Policy.
Calls and texts
If you agree on a form, we may call and text you about your inquiry. Our SMS Terms apply to text messages. You can withdraw consent at any time by replying STOP or by telling us.
Partners and referrals
- Applying to be a partner, or referring a business, doesn’t create a partnership, agency or right to compensation. Compensation is paid only under a signed written partner agreement, on its terms.
- Only refer a business whose contact has agreed to be contacted by us, and only give us information you are allowed to share.
Using the site
Don’t misuse the site. For example, don’t:
- submit false, misleading or someone else’s information without permission;
- try to get into parts of the site or our systems you aren’t meant to reach, or test their security without our written permission;
- send automated or bulk submissions, scrape the site in a way that burdens it, or interfere with how it works;
- upload anything harmful, such as malware;
- use the site for anything unlawful.
Our content and trademarks
The site’s text, design, graphics and code belong to PaymentHelp or its licensors. You may view and print pages for your own business use. Please don’t copy, republish or resell them without our written permission. Other names on the site, including Visa, Mastercard, Stripe, PayPal, Square and Shopify, are trademarks of their owners. PaymentHelp is not affiliated with, endorsed by or sponsored by them.
Other websites
Links to other websites and services are for convenience. We don’t control them and aren’t responsible for their content or practices.
Disclaimers
The site and its content are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We don’t promise that the site will always be available or error-free.
Limits on liability
To the fullest extent the law allows, PaymentHelp will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site, even if we were told they were possible. Our total liability for any claim about the site is limited to one hundred US dollars. Some places don’t allow these limits, so they may not all apply to you.
Your responsibility
You agree to defend and hold PaymentHelp harmless from claims arising from your misuse of the site, your breach of these terms, or information you give us that you weren’t allowed to share.
Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute about them or the site will be brought in the state or federal courts located in Miami-Dade County, Florida, and you agree to those courts’ jurisdiction.
General
We may update these terms by posting a new version here with a new date. Continuing to use the site after that means you accept the update. If any part of these terms can’t be enforced, the rest stays in effect. Not enforcing a term isn’t a waiver of it. These terms, with our Privacy Policy and SMS Terms, are the whole agreement about your use of the site. Any signed agreement with us or a processor governs the services it covers.
